These Terms of Service govern your use of the Oro Lume Candles website and your purchase of products from us. By using our website or placing an order, you agree to these Terms of Service.

1. About Oro Lume Candles

Oro Lume Candles is a South African small-batch candle and home-fragrance business.

Our products are handmade in small batches. Because of the nature of handmade products, minor variations in colour, texture, wax appearance, surface finish and overall appearance may occur between individual products and batches.

These natural variations are not considered defects.

2. Using Our Website

You may use this website for lawful purposes and to browse, select and purchase Oro Lume products.

You agree not to misuse the website, interfere with its operation, attempt to gain unauthorised access to any part of the website, or use the website for fraudulent or unlawful purposes.

3. Placing an Order

When you place an order through our website, you are submitting a request to purchase the selected products.

An order is only confirmed once payment has been successfully received and the order has been accepted by Oro Lume Candles.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

• A product is unavailable;

• An obvious pricing or product-description error has occurred;

• Payment has not been successfully received;

• We suspect fraudulent or unauthorised activity; or

• We are unable to fulfil the order for reasons beyond our reasonable control.

If an order is cancelled after payment has been received, we will contact you regarding the appropriate remedy.

4. Product Availability

We make every reasonable effort to keep the availability information on our website accurate.

However, products may sell out before the website can be updated.

If a product you have ordered is unavailable, we will contact you and arrange an appropriate solution.

5. Product Descriptions and Images

We make reasonable efforts to ensure that product descriptions, fragrance descriptions, photographs, sizes and other product information displayed on our website are accurate.

Actual product appearance may vary slightly from photographs due to lighting, photography, screen settings and the handmade nature of our products.

6. Pricing

All prices displayed on our website are in South African Rand (ZAR), unless otherwise stated.

Prices may be changed at any time without prior notice.

However, a price change will not affect an order that has already been confirmed and paid for.

If an obvious pricing error occurs on the website, Oro Lume Candles reserves the right to cancel the affected order. Where payment has already been received, we will contact the customer regarding the appropriate remedy.

Delivery charges, where applicable, will be displayed during checkout before the order is completed.

7. Payment

Payment must be successfully completed before an order can be processed and dispatched.

Payment methods available at checkout may include Payfast and other payment methods made available through our online store.

Oro Lume Candles does not store customers' full payment-card details.

An order will not be considered paid until payment has been successfully confirmed.

8. Processing and Delivery

Orders are processed after successful payment.

Processing and delivery times may vary depending on the products ordered, delivery method, destination, weekends, public holidays and periods of high order volume.

Once an order has been handed to the relevant delivery provider, delivery times are outside of Oro Lume Candles' direct control.

9. Returns and Exchanges

Oro Lume Candles only accepts returns and exchanges in the circumstances described in our Returns & Exchanges Policy.

We do not accept change-of-mind returns.

Where an approved return or exchange is accepted, the applicable remedy is a replacement or exchange rather than a monetary refund, subject to applicable South African consumer law.

10. Handmade Products

Oro Lume products are handmade in small batches.

Variations may occur between products and batches, including variations in:

• Colour;

• Wax surface;

• Texture;

• Frosting;

• Finish;

• Appearance; and

• Fragrance presentation.

These variations are natural characteristics of handmade candle production and do not necessarily indicate that a product is defective.

11. Candle Safety

Candles are open-flame products and must always be used responsibly.

Customers must follow the candle-burning and safety instructions supplied with the product.

This includes, where applicable, keeping the candle away from children, pets, flammable objects and draughts, never leaving a burning candle unattended, and following the recommended burning and wick-trimming instructions.

Failure to follow the supplied candle-burning and safety instructions may affect the performance of the candle and may create a fire or safety hazard.

Oro Lume Candles cannot be held responsible for damage, injury or loss resulting from misuse of a product or failure to follow the supplied safety and burning instructions, to the extent permitted by applicable law.

12. Fragrance and Product Safety

Oro Lume Candles takes reasonable care when selecting and using fragrance oils and other materials in our products.

Fragrance oils used in our products are used in accordance with applicable International Fragrance Association (IFRA) standards and the relevant supplier documentation and usage guidelines.

Customers must use products only for their intended purpose and in accordance with any instructions supplied with the product.

13. Promotions and Discount Codes

Promotions, discount codes and special offers may be subject to additional terms and conditions.

Unless otherwise stated, promotions and discount codes cannot be combined.

Oro Lume Candles reserves the right to amend, suspend or end a promotion or discount offer at any time.

Any order that has already been confirmed and paid for will not be affected by a subsequent change to a promotion, unless otherwise required by applicable law.

14. Intellectual Property

All content on the Oro Lume Candles website, including but not limited to:

• The Oro Lume name and branding;

• Logos;

• Product photographs;

• Product descriptions;

• Written content;

• Graphics;

• Designs; and

• Other original website materials

belongs to Oro Lume Candles or is used with permission.

This content may not be copied, reproduced, modified, distributed or used commercially without prior written permission from Oro Lume Candles.

15. Website Availability and Accuracy

We make reasonable efforts to keep our website available and its information accurate.

However, we do not guarantee that the website will always be available, uninterrupted, completely accurate or free from technical errors.

We reserve the right to make changes to the website, products, pricing, descriptions or other content where reasonably necessary.

16. Limitation of Liability

To the extent permitted by applicable South African law, Oro Lume Candles will not be liable for indirect, incidental or consequential loss arising from the use of our website or products.

Nothing in these Terms of Service is intended to exclude, restrict or limit any consumer rights that cannot legally be excluded, restricted or limited under applicable South African law.

We respect the privacy of our customers and process personal information in accordance with applicable South African privacy legislation.
